it is not even the correct chassis. it is a head sized chassis instead of the correct SA212 or SA412 chassis.

Wouldn't this constitute fraud and be actionable by a lawyer or two?

One would think so, but I have no idea how the process would work. I would suspect that a purchase reciept would be required. Then you have the tall order of proving that the sleezy seller claimed it was all original.

Maybe the victims will join together and pursue some action.

That's really disheartening that ANY company would want to defraud it's customers like that. Call it factory refurbished. Does it take away from it's "vintageness"? Yes maybe, but not any more than having it recapped or tubed. Even if they went to the trouble of trying to bring it back to it's old glory and calling it factory restored would be honest. I, as the customer would respect that and take that as a good sign, since they are the "manufacturer" etc. MG and Fernandes have not done the Hiwatt name any favors, which is really sad. I'd love to win the lottery and bring to life the companies that I believe in. It's not all about making a buck or pound, it should be about getting a fair compensatory resource for the resource you give out. Bad juju and karma has it's ways of working. Makes me sad as a former MI professional.
